Among the Sworn Statements sent on September 7, 2006 to the Department of Justice by the National Bureau of Investigation (NBI) in NBI’s suit for five counts of ROBBERY and EXTORTION against Ramon TULFO, Raffy TULFO, Erwin TULFO and JIMMY SALGADO is one submitted on August 14, 2006 by a CUSTOMS POLICE assigned at the Customs Port of Manila.

The Sworn Statement was executed before NBI Agents Dickson D. Maraneg and Julio T. Catigan Jr. of the Special Task Force Office at the NBI Headquarters, Taft Avenue , Manila . It was Subscribed and Sworn to before Atty. Reynaldo O. Esmeralda, NBI Regional Director. .

The Sworn Statements were made in Filipino (English translation in parenthesis). Some portions of the Sworn Statements are reproduced here, the names of the Customs personnel omitted.

QUESTION NUMBER THREE: Sa anong kadahilanan at nandito ka ngayon sa aming tanggapan? (Why are you now in our office?}

ANSWER: Upang magbigay ng salaysay tungkol sa alam ko ng pangingikil at pagdala ko noon kay RAMON TULFO ng isang bagong cellphone at pagbigay ng pera sa kanya ng aking boss na si (NAME of BOSS). (In order to relate what I know about the extortion and my bringing to RAMON TULFO a brand new cellphone and the giving of money by my boss,,,,)

QUESTION NUMBER FIVE: Ano ba ang sinasabi mong pangingikil sa inyo ni RAMON TULFO? (What is that extortion, you are saying, on you by RAMON TULFO?)

ANSWER: Noong bandang 2003 galing kami sa aming opisina sa Bureau of Customs, South Harbor, kasama ko si (name of boss) bilang kanyang drayber at pumunta kami sa opisina ni RAMON TULFO sa radio station na DWIZ sa Kapitolyo ng Pasig. Bumaba si (name of boss) sa tapat ng gusali ng opisina ng DWIZ at dala niya ang pera na nakalagay sa isang brown envelope. Saka sinabi niya sa akin na ikot lang ako at ibibigay lang niya ang pera kay RAMON TULFO. Makaraan ang 15-20 minutos sinundo ko ulit si (name of boss) sa pinagbabahan ko sa kanya at sinabi niya na okay na at naibigay na niya. Saka bumalik na kami sa opisina. (Sometime in 2003 we came from our office at the Bureau of Customs, South Harbor , I was with (name of boss) as his driver and we went to the office of RAMON TULFO at the DWIZ radio station at the Pasig Capitol. My boss got out of the car in front of the office building of DWIZ and he was carrying the money which was inside a brown envelope. He told me just to drive around because he would just hand over the money to RAMON TULFO. After about 15-20 minutes, I fetched my boss at the place where I dropped him off and he told me that all is okay and he has already handed over the money. Then we went back to our office).

QUESTION NUMBER SIX: Alam mo ba ang dahilan at nagbigay si (name of boss) ng pera kay RAMON TULFO? (Do you know why –name of boss—gave money to RAMON TULFO?)

ANSWER: Basta ang alam ko ay nahingi si RAMON TULFO dahil ito ang sinabi sa akin ni (name of boss). (What I know is that RAMON TULFO was asking for money because this is what my boss told me.).

QUESTION NUMBER SEVEN: Alam mo ba kung para saan ang perang dinala ni (name of boss) kay RAMON TULFO? (Do you know for what is the money your boss brought to RAMON TULFO?).

ANSWER: Ito daw ay para sa pagbili ng video camera ns tulad sa ginagamit ng mga news reporter. At sinabi ni (name of boss) na nanghihingi si RAMON TULFO ng kamera at kaysa magbigtay kami ng video kamera pera na lang ang ibigay namin sa kanya ang pera at siya na lang ang bibili ng video kamera. (The money is for the purchase of a video camera like the ones used by news reporters. And my boss said that RAMON TULFO was asking for a camera and rather than us giving a video camera we just give him the money and he just buy the video camera.).

QUESTION NUMBER EIGHT: Bakit alam mo na pera ang dala ni (name of boss) na nakalagay sa brown envelope? (Why do you know that the contents of the brown envelope your boss brought are cash money?).

ANSWER: Dahil sinabi na ibibigay niya ang pera na nakalagay sa isang brown envelope at nakita ko rin na pera ang laman ng nasabing enevelope ng ito ay mabuksan ni (name of boss). (Because he said he would give the money contained in the brown envelope which I saw when my boss opened the envelope.).

QUESTION NUMBER NINE: Alam mo ba kung magkano ang halaga nito? (Do you know how much was contained in the envelope?).

ANSWER: Ito ay nagkakahalaga ng Php300,000.00 dahil binilang ito mismo sa harap ko ni (name of boss). (It amounts to Php300,000.00 because it was counted right in front of me by my boss.).

QUESTION NUMBER TEN: Pakituloy ang iyong salaysay. (Please continue your story.).

ANSWER: Bandang 2004 inutusan ako ni (name of boss) na dalhin ko ang isang bagong cellphone kay RAMON TULFO na ang modelo ay una sa Nokia 9500 kaya lang may antenna ito at ang tawag sa cellphone na ito ay “Communicator.” Dinala ko naman ito sa kanyang opisina sa radio station na DWIZ sa Kapitolyo ng Pasig . Ito ay ibinigay ko mismo sa kanyang secretary. Pagbigay ko sa secretary ay kinatok ang kwarto ni RAMON TULFO at sinabing may ibibigay na cellphone galling kay (name of boss). Narinig ko na sumagot si RAMON TULFO at sinabing akin na. Pagkatapos umalis na ako at sinabi ko kay (name of boss) na naihatid ko na ang cellphone. Sinabi naman ni (name of boss) na kausap niya si RAMON TULFO sa telepono. (Sometime in 2004 my boss told me to deliver a new cellphone to RAMON TULFO, an advance model Nokia 9500 which is equipped with an antenna and this cellphone is called “Communicator.” I brought this cellphone to his office at radio station DWIZ at the Pasig Capitol. I gave it to his secretary herself. As soon as I gave the cellphone to the secretary, the secretary knocked at the room of RAMON TULFO and told him that a cellphone from (name of boss) is being given to him. I heard RAMON TULFO answer who said “give it to me.” I left and then I told my boss that I had already delivered the cellphone. My boss told me that he had already spoken with RAMON TULFO over the phone.).

QUESTION NUMBER ELEVEN: Alam mo ba ang dahilan at nagpadala si (name of boss) ng cellphone kay RAMON TULFO? (Do you know why your boss sent the cellphone to RAMON TULFO?).

ANSWER: Ang sabi sa akin ni (name of boss) ay nahingi daw si RAMON TULFO ng ganoong klaseng cellphone kaya siya ay nagpadala nitong klaseng cellphone. Kaya lang hindi ko alam ang rason. (My boss told me that RAMON TULFO was asking for such class of cellphone that is why he sent that class of cellphone. But I do not know the reason.).

QUESTION TWELVE: Magkano naman ang halaga ng nasabing cellphone? (And how much is the cellphone worth?).

ANSWER: Ang alam ko ay more or less Php40,000.00. (What I know is that it is worth more or less Php40,000.00.).
